How do I check if I am in a Trust?

Please visit Māori Land Online to see if you or members of your whānau (family) are owners or shareholders in the Trust/Incorporation.

What is succession?

Succession is the legal transfer of interests or shares in Māori land from a deceased family member to others lawfully entitled to those interests.

The Te Ture Whenua Act 1993 was amended in 2021 to make the succession process much easier. Historically, the majority of succession cases were heard by a Māori Land Court judge. If your succession case is deemed simple and uncontested, it can now be decided by a Māori Land Court Registrar without a court hearing (unless you request to be heard by a judge in a court sitting). If your application is not deemed “simple and uncontested” at any point, a registrar may refer it to a judge for hearing.

How do I apply for succession?

You need to file an application for succession at the Māori Land Court.

You will need to provide the following:

  • Completed Application Papers
  • Certified copy of the Death Certificate
  • The deceased persons will if there is one
  • Details of the deceased’s whānau.
  • Application fee of $60.00


If your name appears on the list of missing owner contacts

If you recognise a name on the list of missing owner contacts and the person is ‘alive’

Please encourage them to contact us for a registration update form at shareregister@arconsultants.co.nz or visit the trust/incorporation they belong to above and download a registration update form, get them to fill it out and send it back to shareregister@arconsultants.co.nz

If you recognise a name on the list of missing owner contacts and the person is ‘deceased’

Please contact us with the name of the deceased person and their date of death. We may ask for proof which could include a death certificate, an obituary, social media posts or photos of the headstone. 

If you find a deceased whānau member on the list and your whānau ‘HAS’ completed a succession with the Māori Land Court

Review the Māori Land Court (MLC) orders you received at the time of succession. If you can’t find the order, the MLC will have a copy. Verify that the Trust Lands are included in the schedule of lands and send us a copy. We will proceed with the necessary transfer of shares.

If the Trust Lands are not listed on the court order, you will need to initiate a succession with the Māori Land Court. For more information, please visit: Māori Land Court Succession Process.

If you find a deceased whānau member on the list and your whānau has ‘NOT’ completed a succession with the Māori Land Court
